Court Fees (Family Law Courts brochure)



The following fees apply FROM 1 January 2013

The Fees are set by Federal Government regulations - Family Law (Fees) Regulations 2012.

Family Court of Australia

$105 Application in a case
$145 Application for consent orders
$1135 Application for declaration as to validity/nullity
$305 Initiating application (family law)
$500* Initiating application (children and financial orders)
$305 Response to initiating application (family law)
$105* Interim application
$765 Setting down for hearing fee (defended matter)
$765 Daily hearing fee (for each hearing day excluding the first day)
$350* Conciliation conference
$50* Issue subpoena
$1205 Notice of appeal to the full court including an appeal from the Federal Circuit Court
$1205* Application for leave to appeal

Federal Circuit Court of Australia

$800 Application for divorce
$265 Application for divorce (reduced fee -see please note section below) 
$305 Initiating Application (Family Law)
$500 Initiating application (children and financial orders)
$305 Response
$105* Interim application
$560 Setting down for hearing fee (defended matter)
$560 Daily hearing fee (for each hearing day, excluding the first hearing day)
$350* Conciliation conference
$50 Issue subpoena

* These are new fees introduced by the Family Law (Fees) Regulations 2012.

The Family Law Courts accept the following types of payment:

  • CHEQUE OR MONEY ORDER
    Should be made payable to the ‘Collector of Public Monies’
  • CREDIT/DEBIT CARDS (VISA AND MASTERCARD)
    in person or by mail
  • CASH OR DEBIT CARD OTHER THAN VISA OR MASTERCARD
    Only accepted if paid in person

Credit card payment form

This form must be included with any mailed application or request when you pay by credit card. Please do not fax this form unless you have been directly requested to do so by the Court.

PLEASE NOTE:

  • GST does NOT apply to any of the fees overleaf.
  • In some cases a reduced fee may be sought for a divorce application, or decree of nullity, or in respect of other fees, an exemption if you hold certain government concession cards or you can demonstrate financial hardship.
  • Where there is more than one applicant to an application, all applicants must meet the requirements for an exemption/reduction or the full fee applies.
