Affidavit of single expert witness



An expert's report must be attached to an affidavit of the expert witness which complies with Rule 15.62 (2). This form called Affidavit of single expert witness has been prepared by the Court for use by a single expert witness to help you comply with Rule 15.62 (2).

What do you do with this form if you are the single expert witness
The expert's report should be attached to this affidavit. The expert's report must:

  • be addressed to the court and the party instructing the expert witness;
  • set out all of the information required by Rule 15.63;
  • have attached to it a summary of the instructions given to the expert witness and a list of any documents relied on in preparing the report.

If you were appointed by the parties, you must give each party a copy of the report at the same time. Either party may file it.

If you were appointed by the Court, you must give the report to the Registry Manager, who will send it to each of the parties if it is released by the Court. The applicant is then required to file the report.

Number of copies of the affidavit for filing, service and yourself
The completed and signed original of the affidavit filed at the Court. Before you file it you must also make sufficient copies to have one for each person to be served and a copy for your own records.
