Notice of Ceasing to Act
This form can only be filed in the Family Court of Australia or the Family Court of Western Australia.
If you are filing in the Federal Magistrates Court of Australia you must use the Notice of withdrawal as Lawyer
This is a mandatory form.*
It is used to:
- inform a client that a lawyer intends to cease to act in seven days and
- inform the Court that the lawyer has ceased to act for the client and provides the Court with the last known residential address of the client.
Making copies of the form for filing, service and yourself
The completed and signed original of the form is filed at the Court. Before you file it you must also make sufficient copies to have one for each person to be served and a copy for your own records.

What you do with this form
Serve the client (by ordinary service) with a copy of the form, to which must be attached a blank Notice of Address for Service. Seven days later file a copy of the form in the Court.
